- When shopping on the website www.lavenueflowers.com, www.theflowerbox.pl a contract is concluded with L'avenue Flowers under the commercial terms and conditions set out in these terms and conditions.
- All content on the website and fan pages, as well as the L'avenue Flowers trademark, is protected by the Act of 4 February 1994 on Copyright and Related Rights.
- The products presented on the website include tax at the current VAT rate.
- Orders can be placed by the customer via the website www.lavenueflowers.com, www.theflowerbox.pl, email sklep@lavenueflowers.com, as well as by telephone at +48 733004663, after entering the data into the computer system.
- These terms and conditions are addressed to consumers and businesses using the online shop.
- The products presented in the Polish version of the website are available throughout Poland, in the German version throughout Germany, in the Czech version throughout the Czech Republic, in the French version throughout France, and in the English version throughout the European Union.
- We are not responsible for third-party sites to which you are redirected from our site, even as a result of transactions on our site.
PRODUCTS
- Some flowers may have thorns at the stems or may cause sensitisation.
- Some products may not be available at any given time, even though it is possible to purchase them on the website. In this case, we reserve the right to replace them with a similar product or one of similar value and quality.
- In the event that an order, or part of an order, cannot be fulfilled, the customer will be informed and payment will be refunded, no later than within 7 days of payment.
- L'avenue Flowers guarantees the freshness of live flowers, for 3 days after delivery to the recipient, when cared for according to the recommendations presented in the section: Frequently Asked Questions/FAQs.
- The colour of the roses/blushes shown in the photos on the page www.lavenueflowers.com, www.theflowerbox.pl may vary in shade in person, as the photo does not reflect the actual colour of the product.
- L'avenue Flowers guarantees the condition, as shown in the product photo of the everlasting flowers, for 1 year after delivery to the recipient, when cared for according to the recommendations presented in the Frequently Asked Questions/FAQs section. Everlasting roses in flower boxes are sold as rose heads.
- 7. the quantity of roses may differ from the photos presented on the website or in the product descriptions by up to half. Products are sold by the size of the box, not by the number of flowers. An inadequate number of flowers to fill an entire box cannot be a cause for complaint.
- Products containing live roses and everlasting roses are made to order for the customer and are not subject to the return rights of the Civil Code.
- Everlasting roses, once they have been arranged in a flowerbox and unwrapped from their vacuum packaging, cannot be reused. Despite holding their colour and shape for 2 years, they become fragile and cannot be sent back, touched - they must be handled gently.
- Eternal roses sold in colour mixes may change colour to the colour of the neighbouring rose head and this cannot be a cause for complaint.
- Fountain roses must not be stored in damp places or watered; if the customer does not follow the instructions, complaints will not be taken into consideration.
- Fountain roses may change their colour over time, especially the colour may become less intense or even white, this cannot be a cause for complaint.
- Roses that are arranged in a box, i.e. Flower Box, may tint the colour of the box from the inside which cannot be a cause for complaint.
ORDERS / PAYMENTS
- By placing an order via the website www.lavenueflowers.com / www.theflowerbox.pl easy-to-understand messages are provided explaining how to proceed to the next step in ordering. When placing an order, we require you to provide us with your personal details, a contact number, as well as the address where the parcel is to be delivered.
- The order can be placed 24 hours a day, 7 days a week
- During the payment process, the services we use require payment details
- When placing an order via the website, payments are made by credit card as well as PayPal, PayU, ApplePay, GooglePay
- When placing an order by telephone or e-mail, funds must be transferred to the account number PL 14116022020000000593034787 , SWIFT: BIGBPLPW, MILLENIUM BANK, indicating the order number in the title.
- The processing of the order can only be started once payment has been credited to the account.

- All data you enter on our website is fully protected. SSL technology is used, ensuring the highest standards of security.
- You can cancel your order up to 20 minutes after placing it by contacting us by phone or by sending an email to sklep@lavenueflowers.com. L'avenue Flowers may cancel your order within 24 hours of placing it, without giving any reason.
- If the Customer does not pay for the order immediately after placing it, the order is given the status: Pending payment. Then, even after payment, delivery may not take place on the date chosen by the Customer. In this case, a confirmation should be sent to sklep@lavenueflowers.com immediately after payment.
- If the customer would like to receive delivery on the chosen date, they must first contact L'avenue Flowers by telephone or at the email address provided, to confirm the delivery date.
- DELIVERY
- Delivery is via UPS courier, InPost parcel machines, as well as via a local delivery service in Warsaw and the surrounding area.
- During the purchasing process, select the available estimated delivery date (optional).
- On the territory of Warsaw and its surroundings, deliveries are carried out between 4 p.m. and 10 p.m. from Monday to Friday. On Saturdays from 10 a.m. to 2 p.m. Exceptions are special days such as Valentine's Day, on which day flower deliveries are made from Monday to Friday from 10 a.m. to 10 p.m., depending on which day 14 February falls on.
- When delivering a parcel to an address, the courier may leave it with a person other than the one addressed in the order, as well as, in exceptional circumstances, leave it with a neighbour or in another accessible place.
- Delivery takes place from Monday to Saturday. On Saturdays only to cities accessible by postcode, i.e. within Warsaw and the surrounding area.
- Saturday delivery is made between 10.00 a.m. and 2.00 p.m.
- Delivery between 4 p.m. and 10 p.m. is possible from Monday to Friday. If the courier finds a person at the indicated address, he may deliver the order at an earlier time
- All orders via courier service are shipped with guaranteed delivery on the day selected by the customer, however delays may occur on the part of the carrier for which we cannot be held responsible. In such cases, we will issue a consignment note confirming correct dispatch.
- As part of the delivery we provide one delivery per day, it is therefore required to select the delivery option where the courier will find the recipient at the indicated address
- In the event of the recipient's absence, the product must be collected at the collection point located in the advo. In some cases, it may be necessary to collect the parcel from the collection point without delivery. If the parcel is placed in a parcel collection point according to the delivery method selected on the order, the recipient is obliged to collect the parcel, in case it is not collected, it will be re-sent to the recipient's address, at the recipient's expense. The shop is not responsible in such a situation for the condition of the flowers in the parcel, as the flowers should be collected immediately after the parcel is delivered to the point (within 24 hours maximum) due to the nature of the product - everlasting flowers must be stored in appropriate conditions.
- If the recipient is absent during delivery, it is not possible for the courier to redeliver the consignment on the same working day
- In the case of smaller towns or villages, the hourly delivery interval may differ from that chosen by the buyer.
- The courier is not obliged to contact the recipient before delivery.

- From receipt of payment, the order will be forwarded for dispatch within a maximum of 5 working days.
COMPLAINTS
- L'avenue Flowers shall be liable to the Customer for non-conformity of the goods with the sales contract, in particular to the extent set out in the Civil Code.
- Complaints are possible in the following situations:
- the flowers will not be fresh when delivered on time (if the recipient is absent and collects the product at a later date, the guarantee is calculated from the day on which the consignment was to be delivered
- the parcel will not be delivered
- the order will not correspond to the one selected by the customer on the site.
In the event of non-delivery, a written statement from the addressee about the incident is essential in the complaints process.
- In the case of a visibly damaged parcel being delivered to the customer, the customer is obliged to write a damage report in the presence of the courier or refuse to accept the parcel. If the customer accepts a consignment that has damaged packaging and does not follow the steps outlined above, the complaint will not be considered.
- In the situation of non-delivery due to the fault of the courier, we issue the necessary documents for the Customer to make a claim on his behalf to the courier company. As L'avenue Flowers completes all the details contained in the agreement with the Customer, we are not liable in a situation where the courier is solely at fault.
- (a) a delay of 1 day due to an error on the part of the courier cannot be the reason for a refund of the order and is not subject to a claim
- In the case of perennial roses, the guarantee is given for a period of one year, only if the customer has cared for the product according to the recommendations in the Frequently Asked Questions section.
- Withdrawal from the contract under the terms of the Civil Code is possible except for live roses, fountain roses and helium balloons. These products have expiry dates and are made to order, which means that they cannot be used in the event of a return.
- In the event of a claim for a refund due to the condition of the flowers themselves, we will only refund the cost of the flowers, without the cost of the box. If the consumer claims a full refund, he/she must send the box back properly protected and in undamaged condition to the return address. Return address: ul. Warszawska 55 lokal 211, 05-075 Warsaw.
- In order to document the non-conformity of the goods with the contract, a photo of the product must be sent to the e-mail address or mms within 24 hours of receipt. Otherwise, complaints will not be considered.
- All products consisting of live roses or so-called 'everlasting roses', apart from compositions with artificial flowers - are made to individual order - even though they appear in the generally available online shop. This means that they cannot be returned or exchanged for another product. In the event of a complaint, we are liable under the law for the non-conformity of the consumer goods with the contract.
- We are not responsible for a printing error in preparing the content of the leaflet, or for cutting off part of the content if it exceeded 200 characters.
- Complaints should be submitted to the email address: sklep@lavenueflowers.com by sending a photo of the advertised product.
- L'avenue Flowers is financially liable only up to the value of the order.
- If you withdraw from the contract for a product for which you are entitled to the statutory option, we will refund the amount for this product less the shipping cost and the value of the protective packaging.

To facilitate the complaint process, the complaint notification should include:
Order number, description of the defect with date of occurrence, photo of the damage, contact details of the person making the complaint.
- The customer may request that the product complained of be repaired or replaced with a new product - in accordance with the contract. In the event that the method chosen by the Customer to bring the product into conformity with the contract proves impossible or excessively costly for L'avenue Flowers, - L'avenue Flowers may bring the product into conformity with the contract by repair instead of replacement or by replacement instead of the repair requested by the Customer.
- If both repair and replacement of the advertised product prove to be unsuccessful, the customer may submit a declaration of withdrawal from the contract, i.e. a refund of the cost of the product to the customer, or demand a reduction in the price of the advertised goods - in consultation with the buyer and seller.
*The certificate of withdrawal in the complaint process will be sent to the customer immediately after the complaint is made - either by e-mail or in paper form to the address indicated by the customer, at the customer's discretion. If the customer chooses the complaint options: withdrawal from the contract, repair or replacement of the defective product, he/she is obliged to send back the advertised product together with a statement of withdrawal from the contract, no later than 7 days from the moment of submitting the complaint included in point. 1 to the address ul. Gościniec 100/16, 05-077 Warsaw.
- L'avenue Flowers will consider the complaint within 14 days and will inform the Customer of how the complaint has been handled by email or text message.
- The cost of shipping the goods complained of to the L'avenue Flowers shop shall be borne by the customer. L'avenue Flowers will refund the shipping cost to the purchaser to the bank account indicated, once the complaint has been accepted.
- In the case of positive consideration of a complaint submitted by post, e-mail, the Customer shall receive a refund for the advertised item, and a refund of the incurred, expedient costs of sending the defective goods to the e-shop - after sending a copy / scan of the proof of their incurrence to the e-mail address: info@lavenueflowers.com, sklep@lavenueflowers.com
- In the event that a complaint sent by post or courier service is not accepted, the customer will be informed of the reason for non-acceptance at the e-mail address shown on the order and the goods will be sent back to the address from which the complaint was sent.
- In the event that a complaint made at a L'avenue Flowers salon is successful, the refund due to the customer will be refunded at the salon where the complaint was made.
- If a complaint made in a stationary store is not accepted, the customer will be informed of this by e-mail or text message, depending on the customer's choice, and is obliged to collect the goods at the store where he or she made the complaint within 14 days of receiving notification
PRIVACY POLICY

(h) withdraw consent at any time (without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal)
